Abstract

The courts of Dubai faced many disputes resulting from the pandemic and its repercussions, and the Dubai Rental Dispute Settlement Center played a key role in ruling on requests to terminate commercial lease contracts or reduce rent. This study aims at inferring the factors that have affected the decisions of the Center’s committees, reaching the following conclusions. On the one hand, the main factor to determine whether a specific damage was caused by the epidemic or not is the extent to which the commercial activity is connected to customers. On the other hand, the committees have issued diverse decisions with regard to the nature of the same commercial activity, the key factors being the tenant’s requests, the length of the lease term and the extent of the specific damage caused by the epidemic.

Résumé / خلاصة

واجهت محاكم دبي العديد من المنازعات الناتجة عن الوباء وتداعياته، وكان "لمركز فض المنازعات الإيجارية في دبي" دوراً اساسياً في النظر بطلبات فسخ عقود الايجار التجاري او تخفيض الأجرة. فكانت هذه الدراسة لاستنباط العوامل التي أثرت في قرارات لجان المركز، حيث تم استنتاج التالي: من ناحية اولى إن العامل الأبرز لتحقق الضرر الخاص الناجم عن الوباء او انعدامه هو مدى اتصال النشاط التجاري بالزبائن. ولكن من ناحية اخرى اختلفت قرارات اللجان في ظل طبيعة نشاط تجاري واحد، وكانت العوامل الموثرة بذلك طلبات المستأجر وطول مدة عقد الايجار كما وحجم الضرر الخاص الناجم عن الوباء.
