Abstract

The importance of the "qawaed kulliya" (Fundamental Rules) lies in the fact that they are recognized in the various laws due to the values they represent, arising from sound logic. They are called kulliya because they are the source from which legal provisions derive, and they help in understanding the causes and aims of rules allowing for deduction and analysis. The UAE being sensitive to the importance of the Fundamental Rules has dedicated a special chapter to them, titled "Certain Doctrinal Interpretative Rules", in the Civil Transactions Law promulgated by the Federal Law No. 5 of 1985. In acknowledgment of the position of Fundamental Rules in the UAE legislation, the present article aims, in a first part, at defining their characteristics and determining their function, before addressing in a second part some legal provisions deriving from them.

تكمن أهمية القواعد الكلّية في أنها القواعد المتفق عليها بين مختلف التشريعات لما تُثّله من قِيَم وحسٍّ صادرين عن منطقٍ سليم، وسُميت بالكلّية لأنها بمثابة الأصل الذي تتفرع منه النصوص القانونية، وهي تُعين على فهم علل ومقاصد الأحكام وتسمح بإعمال الاستنباط والتحليل. ولقد تنبّهت دولة الإمارات العربية المتحدة إلى مكانة القواعد الكلّية فأفردت لها فصلاً خاصاً في قانون المعاملات المدنية الصادر بموجب القانون الاتحادي رقم ٥ لسنة ١٩٨٥ معنوناً "بعض قواعد الأصول الفقهية التفسيرية"، ولقد تضمّن هذا الفصل مجموعة من القواعد الكلّية. وبياناً لهذه المكانة في التشريع الاماراتي كانت هذه الدراسة التي تهدف إلى التعريف بالقواعد الكلّية وخصائصها مع بيان وظيفتها في مرحلة أولى وعرضٍ لبعض النصوص القانونية المتفرعة عنها في مرحلة ثانية.
